“After reviewing the Group's forecasts and projections, the members have a reasonable expectation that the Group has adequate resources to continue in operational existence for the foreseeable future. The LLP therefore continues to adopt the going concern basis in preparing its consolidated financial statements. In addition to partner funding, the Group's external working capital requirements are provided in the form of overdrafts, term loans and a revolving credit facility. In July 2024, AIB and HSBC entered into a revised bank facility agreement to provide funding to Kennedys Law LLP for a period of three years and with options to renew for a further two years. The total amount of the facility was £88m and is secured by a debenture in favour of AIB and HSBC as a charge over the assets of the LLP and supported by designated guarantors within the Kennedys Group. There is Accordion Option of £10m built into the facility that can be exercised after 24 months of the facility signing date. In addition to main banking facility, a Professional Indemnity (PI) Term loan facility of £8m was entered into and is renewable on an annual basis. During the year under review, and subsequently, the business has remained robust and continues to operate profitably. Global cash flow forecasts and financial modelling looking forward 2 financial years have provided the members with confidence that the future business outlook remains profitable and cash generative.”
